Freddie Mac   today released the results of its Primary Mortgage Market Survey® (PMMS ® ), showing average fixed mortgage rates lower again this week following the release of weaker housing data. News Facts 30-year fixed-rate mortgage (FRM) averaged 4.32 percent with an average 0.7 point for the week ending January 30, 2014 , down from last week when it averaged 4.39 percent. Positive equity is not a barrier to foreclosure | Pound Ridge Real Estate

Although rising home prices have pushed many homeowners out of negative equity, escalating values are not a panacea for all distressed borrowers. A growing percentage of borrowers are now entering foreclosure with positive equity in their homes, a new report from Fitch Ratings claims. According to the study, the percentage of borrowers entering this process with equity has roughly doubled in the last two years. While equity continues to play a significant role in borrower payment behavior, income and the ability-to-pay also remain key factors. In September 2013, RealtyTrac discovered that 24% of all homeowners who are in some stage of foreclosure have at least some positive equity built up. By December 2013, that number continued to rise and 31% of people in the foreclosure process were struggling despite the presence of positive equity. Just north of downtown Los Angeles, skinny homes on tiny lots are sprouting from the hillsides — a building boom of miniature proportions. The rectangular structures come in clusters of six or 15, or even 70, and developers are racing to build them in trendy Silver Lake and Echo Park. They're eyeing younger home buyers who crave hip cafes and proximity to work but don't want a sky-high condo or a Craftsman bungalow. The so-called small-lot homes speak to a growing desire for a more compact and walkable Los Angeles, while still clinging to the single-family ideal that spread outward from downtown over the last century. The homes often have a small patio or roof deck but no backyard. Distressed Sales Bumped Up Last Year | Chappaqua NY Real Estate

Just to prove that they are not quite ready for the history books, sales of foreclosures and short sales increased slightly last year. Institutions bought 7.9 percent of all homes.   RealtyTrac reported that short sales and foreclosure-related sales — including both sales to third party buyers at the public foreclosure auction and sales of bank-owned properties — accounted for a combined 16.2 percent of all U.S. residential sales in 2013, up from 14.5 percent of all sales in 2012 and up from 15.2 percent of all sales in 2011. The median price of a distressed residential property — in foreclosure or bank-owned — was $108,494 in December, 38 percent below the median price of $174,401 for a non-distressed residential property. “It may surprise some to see distressed sales rising in 2013 given that foreclosure starts dropped to a seven-year low for the year,” said Daren Blomquist, vice president at RealtyTrac. “And while short sales did trend lower in the second half of the year,

Insatiable demand from hedge funds, private equity investors and foreign buyers, all armed with ready cash, are elbowing first-time buyers out of the housing market. First-time buyers tend to purchase lower-priced homes, but all-cash investors have cornered the market on those, leaving little behind. All-cash purchases accounted for 42.1 percent of all U.S. residential sales in December, up from 38.1 percent in November, and up from 18.0 percent in December 2012, according to a new report from RealtyTrac . The phenomenon is putting up another roadblock for young Americans already assailed by high student loan debt, poor wage growth and less-than-pristine credit. First-time homebuyers, historically about 40 percent of the market, accounted for just 27 percent of sales nationally in December, the lowest since the National Association of Realtors began tracking this cohort in 2008. Bedford resident Kerry Kennedy's trial for driving under the influence will begin on Monday, Feb. 24 in White Plains. Kennedy appeared in Westchester County Court on Thursday for a pretrial conference, where the court date was set by Judge Robert Neary. The jury selection for the trail will take place Thursday, Feb. 20 and Friday, Feb. 21, though Kennedy will not be present for those days because she will be out of the country. Kennedy is the daughter of Robert F. Kennedy, niece of John F. Kennedy and ex-wife of Gov. Andrew Cuomo. She was arrested in July 2012 in Armonk after an accident in which her Lexus hit a tractor-trailer. She was charged with driving under the influence of an unknown substance, a misdemeanor.
